Enforcement activities

This report contains information about non-prosecution enforcement activity undertaken under Health and Safety in Employment Act 1992 (HSE) and the Health and Safety at Work Act 2015 since 2010. These notices result from assessment and investigations undertaken by WorkSafe.

This report allows you to see the type of notices, where in the country, and to what industries the notices are being issued.

The graph shows the number of non-prosecution enforcement (as detailed below) issued by WorkSafe between 1 January 2010 and the most recent update.

This data includes the following types of notices:

  • Written Warnings (HSE only)
  • Negotiated Agreements/Agreement Letters (HSE only)
  • Improvement notices
  • Prohibition Notices
  • Hazardous Substance and New Organism (HSNO) compliance orders
  • Infringement notices.

  • This table provides counts of enforcement by year, month, industry level 1 and 2, region, and notice type.
  • This table includes enforcement issued from 4 April 2016 onwards, after the Healthy and Safety at Work Act 2015 (HSWA) came into effect.

  • This table provides counts of enforcement by year, month, industry level 1 and 2, region, and notice type.
  • This table includes enforcement issued from 1 January 2010 to 3 April 2016, under the Healthy and Safety in Employment Act 1992 (HSE).

  1. The year and month variables are calculated based on the date the notice was issued.
  2. Improvement, Prohibition, or Infringement notices issued under HSE are prefixed with ‘HSE’.
  3. Improvement, Prohibition, or Infringement notices issued under HSWA are prefixed with ‘HSWA’.
  4. There are some HSE notices in the HSWA tables. This is due to the notices being issued after 4 April 2016 as a result of engagements occurring before this date.
  5. While this report uses the Australia New Zealand Standard Industrial Classification (2006) system, the Agriculture, Forestry and Fishing industry has been modified to provide additional detail (see AFF2017 variable).
  6. Data quality has improved over time so caution is advised when interpreting the data.
